(a) which, at our discretion, encourages aggressive behaviour, is discriminating or is otherwise deemed hurtful, offensive or inappropriate or that consist of creating a false identity;

(b) that consist of child pornography and/or distributing pornographic materials to minors;

(c) in which personal data is made available, other than in compliance with applicable law;

(d) which contains viruses, Trojan horses, worms, bots or other software which can damage automated work or make it unusable or inaccessible or delete it, or which can appropriate it or which is intended to circumvent our technical protection measures of and/or the computer systems;

(e) which qualifies as or transmits unwanted or unsolicited material or content (spam);

(f) which infringes our rights of and/or of third parties, including but not limited to intellectual property rights or rights concerning the protection of privacy;

(g) which qualifies as or transmits unwanted or unsolicited material or content (spam);

(h) which is fraudulently or in connection with a criminal offence or in any way illegal or unlawful.

5. In the event of a suspicion of misuse within the meaning of article 5.4, we may be legally obliged to inform the appropriate authorities of that suspicion. If we are legally obliged to do so, or see any other reason to do so, your details will be passed on to the appropriate authorities.

We do not guarantee that the Service shall be available to you at all times and without interruptions, faults or disturbances, that the Service shall be effective, or the use of the Service shall lead to certain results or that the information provided through the Service shall be accurate, up to date and complete.

Responsibilities and liabilities of us and you

Benefits you receive are your responsibility. We will not be held liable for any loss arising from you failing to ensure their safe keeping.

Benefits you receive cannot be transferred (unless expressly mentioned in the particular offer), bought, sold or in any way traded. Only one Benefit can be used at any one time and cannot be combined with any other Benefit.

All Benefits are subject to an expiry date, beyond which they cannot be used or reissued. Benefits that are lost or mislaid will not be reissued. Benefits are only redeemable at the location stated.

Many Benefits we communicate to you are offered by participating brands or retailers themselves. We do not (other than as required by applicable law): (i) take any responsibility for the offers provided by the participating brands or retailers; and/or (ii) provide any warranties regarding the goods (including without limitation the quality thereof) that you may obtain through the offer at the relevant participating brand or retailer. You shall have no right to make any claim against us or the Newsletter programme in the event that a participating brand or retailer fails to honour an offer made by that participating brand or retailer.

Our liability, whether based upon (attributable) default, unlawful act or any other ground, shall not exceed the amount of EUR 500.

FASHION CLUB BENEFITS

1.1 Overview

The Fashion Club enables members to receive various benefits from time to time, including the ability to make savings at the Centre by collecting loyalty credits on particular purchases (we call these Benefits “Loyalty Credits”), and access to special offers, promotions and discounts at the Centre (we call these Benefits “Offers"). For the avoidance of doubt, Loyalty Credits do not constitute a payment instrument.

Once you have joined the Fashion Club, we will issue you with a unique code by email. Alternatively, you can collect a Fashion Club membership card (“Fashion Club Card”) from the Tourist Information Centre or you can download and register for our Fashion Club mobile app (“Fashion Club App”) or via the Centre website (your account page). All methods of using the Fashion Club membership (email, Fashion Club Card or Fashion Club App) use a unique code (“Unique Code”) and as a member of the Fashion Club you can use this Unique Code, to participate in the Fashion Club and redeem the Benefits you have collected. As a member of the Fashion Club you can choose to use either the unique code sent to you via email, a Fashion Club Card or the Fashion Club App to participate in the Fashion Club and redeem any Benefits.

The Unique Code is limited to one per registered member and are for personal use by the registered member only.

You must present your Unique Code at the checkout of the relevant Participating Retailer’s store to redeem the Benefits that are offered by that Participating Retailer. Please see section 1.3 (Loyalty Credits) for more information about how to redeem Loyalty Credits, and section 1.4 (Offers) for more information about how to redeem Offers.

Provided you have consented to receiving marketing emails from us, as a member of the Fashion Club, we will also send you Offers by email. To redeem these Offers, you may also be required to present the email containing details of the Offer at the relevant Participating Retailer’s store.

1.2. Participating Retailers

Loyalty Credits and Offers only apply to brands and retailers at the Centre who choose to participate in the Fashion Club (“Participating Retailers”).

The Participating Retailers may change from time to time. Additionally, it may be the case from time to time that not all Participating Retailers are participating in the Fashion Club in relation to both the Loyalty Credits and Offers; some Participating Retailers may only participate in the Loyalty Credits and some may only participate in the Offers. For instance, food and beverage retailers will not participate in collecting and redeeming Loyalty Credits.

A list of the current Participating Retailers for the Loyalty Credits and the current Participating Retailers for the Offers is available at https://freeportfashionoutlet.pt/en/terms-and-conditions-fashion-club/. We will update this list from time to time so please review this list before visiting the Centre.

1.3. Loyalty-Euros

Collecting Loyalty Credits

For every purchase you make at a Participating Retailer’s store, you are entitled to collect 5% of the value (including VAT) of your purchase in Loyalty Credits.

The Loyalty Credits will be recorded to your Fashion Club membership account.

In order to collect Loyalty Credits for a purchase you make at a Participating Retailer’s store, you must present your Unique Code at the checkout of that Participating Retailer’s store when you make the purchase. If you forget to do this or you believe that the Loyalty Credits were not properly recorded to your Fashion Club membership account at the time of the transaction, you may have the Loyalty Credits added up to 14 days after the transaction upon production of a valid original cash register receipt at the Participating Retailer’s store of purchase, provided the receipt belongs to the claiming member and is based on their personal spend. Loyalty Credits can only be added in relation to purchases made since you became a member of the Fashion Club. Receipts that pre-date the date of your membership cannot be added.

Loyalty Credits are allocated to your account based on qualifying spend and are not rounded up, for example, spend of €99.99 will mean a credit of €4.99, a spend of €100 Euros will mean a credit of €5.

Loyalty Credits recorded to your Fashion Club membership account may be removed or cancelled (in whole or in part) if we determine that such credits were collected in breach of these Terms or were awarded in error. For the avoidance of doubt, any advice or action of staff members at the Participating Retailers or at the Centre that is contrary to these Terms will not have the effect of changing these Terms.

If you do not use your Unique Code to collect or redeem Loyalty Credits for a period of 12 months, you will lose the Loyalty Credits you have collected up to that point.

Redeeming Loyalty Credits

You can redeem Loyalty Credits on qualifying purchases at Participating Retailers’ stores. The maximum amount of Loyalty Credits that you can put towards a purchase is 25% of the value of that purchase (including VAT). Loyalty Credits cannot be converted into money or cashed otherwise.

Please be aware that redemption may not be possible on certain items, particularly in combination with special promotions or goods offered with an additional discount to the outlet price. This shall be clearly communicated to you by the Participating Retailer.

Only integer percentages may be discounted from an item, for example, you purchase an item with a selling price of €89, and you have €5.80 in Loyalty Credits, the most you can redeem is €5.34 as this is 6%, you do not have enough credit to redeem 7% and they system will not allow 6.5% to be redeemed.

Redemption of Loyalty Credits are rounded down, based on a full percentage being redeemed, for example, purchasing an item at €89.99 and you have €5.40 in your account, the system will allow you to redeem 6% of the value if the item, which is technically €5.3994, the item will be reduced by €5.39, not €5.40.

In addition, you may be prevented from redeeming Loyalty Credits if: (i) the Participating Retailer has reason to suspect fraud or misconduct on your part or in the way you are using the Loyalty Credits; or (ii) we determine that the Loyalty Credits were collected in breach of these Terms or were awarded in error.

Returning goods for which you have collected or redeemed Loyalty Credits

When returning your goods, you must present your Unique Code at the checkout of that Participating Retailer.

If you collect Loyalty Credits when purchasing goods at a Participating Retailer’s store and you later decide to return those goods for any reason, the Loyalty Credits recorded to your Fashion Club membership account will be deducted.

If you redeem Loyalty Credits when purchasing goods at a Participating Retailer’s store (i.e., you have partially paid for your goods using your Loyalty Credits) and you later decide to return those goods for any reason, the Loyalty Credits used will not be restored to your Fashion Club membership account. If you collect any Loyalty Credits as part of the same transaction the Loyalty Credits recorded to your Fashion Club membership account will be deducted as set out above.

When returning goods for which you have collected or redeemed Loyalty Credits, the returns policy of the Participating Retailer shall also apply to those goods.

1.4. Offers

Receiving Offers

Participating Retailers may provide Offers for members of the Fashion Club from time to time. You can view most Offers on our website at https://freeportfashionoutlet.pt/en/terms-and-conditions-fashion-club/ and in the Fashion Club App.

Provided you have consented to receiving marketing communications from us, as a member of the Fashion Club, we will also send you Offers by email. Offers will be subject to availability and subject to their own additional terms and conditions imposed by the offering Participating Retailer (for example, closing dates and exclusions). We will direct you to these additional terms and conditions at the time we communicate with you about the relevant Offer. Please read those additional terms and conditions carefully before redeeming the Offer. By redeeming an Offer, you signify your agreement to be bound by those additional terms and conditions.

From time to time, it may be necessary to withdraw or amend Offers from the Programme. Where reasonably practicable, we will provide advance notice of such withdrawals and amendments.

Redeeming Offers

To redeem an Offer, you must present your Unique Code at the checkout of the relevant Participating Retailer’s store. Where you have received an Offer from us by email, you may also be required to present the email containing details of the Offer at the relevant Participating Retailer’s store.

You may be prevented from redeeming an Offer if: (i) the Participating Retailer has reason to suspect fraud or misconduct on your part or in the way you are using the Offer; (ii) the Offer was communicated to you in error due to a technical fault; or (iii) the Offer was made in error.

MEMBERSHIP OF THE FASHION CLUB

1. Joining the Fashion Club

To be a member of the Fashion Club, you must be aged 18 years or older and have a valid email address so that we can communicate with you about your membership.

You can apply for membership by completing the application form available at the following locations:

the Centre’s website at https://www.freeportfashionoutlet.pt/en;
the Fashion Club mobile app for the Centre, which you can download from the app store of any IOS and Android mobile device. Please note that terms and conditions may be imposed by your service provider or the portal from which you download the mobile app. You should read these carefully before you accept them. These do not form part of your relationship with us. Please also note that whilst the app is available for free, you may incur standard data charges when you download it. Please contact your telecom service provider to find out about data charges that may apply to you.

on scanners at Participating Retailers’ stores of the Centre, but please be aware that whilst you will be able to save Loyalty Credits, you will not be able to redeem credits on your Unique Code until such time that you have completed your registration online or via the Fashion Club App.

Membership of the Fashion Club is free for you and involves no obligation to buy any products or services whatsoever. As part of your membership you will receive service emails from us informing you of your credits and any changes to your Fashion Club membership or the programme. You may also receive a service email with a yearly statement of your Fashion Club usage.

As an additional Benefit of Fashion Club we may offer an annual birthday gift, you must provide us with your date of birth, valid email address and opt in to receive this, please note this is not guaranteed.

Membership of the Fashion Club is entirely at our discretion and accordingly we can refuse an application for any reason. An individual may only have one active Fashion Club membership at any one time. We reserve the right to refuse, merge or close additional memberships at any time. We reserve the right to monitor the number of memberships in any household, and the right to cancel any suspected duplicated memberships.

2. End of your membership, termination or suspension of the Fashion Club

You may choose to leave the Fashion Club at any time by sending an email to us at Privacy.Freeport@viaoutlets.com.

As a member, you must keep us informed of any changes to your personal membership details (for example, your email address). You can inform us of changes to your personal membership details by sending an email to us at Privacy.Freeport@viaoutlets.com, or via the ‘Your Personal Details’ space online via the Freeport Lisboa Fashion Outlet website. We will not be responsible for any loss of any Benefits (such as any special offers, promotions or discounts) resulting from your details being out of date or inaccurate.

We may, at any time, in our sole discretion and without reason, terminate or suspend the Fashion Club. We will endeavour to let you know at least two (2) months in advance, however we may not be able to do so if there are technical problems or security issues or we are required by applicable law to terminate or suspend the Fashion Club on shorter or no notice.

We also reserve the right to add to or change the Benefits of the Fashion Club, how you collect Loyalty Credits and how we evaluate and reward your qualifying purchases and/or other Fashion Club activity. We also reserve the right to place limits on the number of purchases or activities that you can put towards the Benefits of the Fashion Club and/or the number or types of Benefits you may receive or collect in a given time period or for the duration of the Fashion Club, and/or any combination thereof.

We may terminate your membership of the Fashion Club at any time in the event that: (i) we terminate the Fashion Club; (ii) we reasonably believe that you have breached these Terms and/or any additional terms and conditions relating to certain Benefits; or (iii) we reasonably believe that you have behaved in an inappropriate, misleading or abusive manner, or in a way which is fraudulent or illegal.

Please note, we may share your personal data with third party organisations in order to establish, exercise, defend or protect the rights, property or safety of our business, our guests or others. This includes, in specific cases, exchanging information with other third party organisations for the purposes of fraud protection. Where your membership of the Fashion Club is terminated for any reason, from the date of termination you will not be able to: (i) collect any Loyalty Credits; (ii) redeem any Loyalty Credits already collected; (iii) redeem any Offers made available to you prior to the cancellation of your membership; or (iv) use any other Benefits of the Fashion Club.

RESPONSIBILITIES AND LIABILITY OF US AND YOU

The Fashion Club, the Unique Code and Benefits of the Fashion Club are for personal and private use by members only and must not be used for or in connection with any business transaction or purpose.

The Unique Code and Benefits of the Fashion Club cannot be transferred (unless expressly mentioned in the additional terms and conditions that apply to a particular Benefit), bought, sold or in any way traded and can only be used by the member who is registered for the Unique Code and has collected or received the Benefits.

The safe-keeping of your Unique Code (including the mobile device on to which it is downloaded) (as applicable) is your responsibility, as are any security details relating to your Fashion Club membership account. We cannot be held responsible for any loss arising from you failing to ensure the safe-keeping of these items. You must treat such security details as confidential and must not disclose this information to any third party.

If you notify us that you have lost your Fashion Club Card or there has been a breach of security in relation to your Unique Code or the Fashion Club App on your mobile device, we may be able to block your membership account or the Unique Code which was sent to you by email or is associated with your Fashion Club Card or Fashion Club App (as applicable). Our ability to do so depends on how quickly you inform us of the loss of your Fashion Club Card or breach of security in relation to your email or the Fashion Club App on your mobile device. To notify us, please visit our Information Centre or contact us at freeport.info@viaoutlets.com. Please note that, in order to unblock or retrieve your membership, you will need to visit our Information Centre, where we may require you to show us photographic proof of identity so that we can confirm your membership.

Many Offers are subject to an expiry date, beyond which they cannot be used or reissued. Offers that are lost or mislaid will not be reissued. Offers are only redeemable at the Centre and Participating Retailer stated.

In addition, many Benefits that are made available to you as a member of the Fashion Club are offered by Participating Retailers. We do not (other than as required by applicable law): (i) take any responsibility for any Benefit offered by a Participating Retailer; and/or (ii) provide any warranties regarding the goods (including without limitation the quality thereof) that you may obtain through a Benefit offered by a Participating Retailer. You shall have no right to make any claim against us or this Fashion Club in the event that a Participating Retailer fails to honour a Benefit offered by that Participating Retailer. Whilst we will try to ensure that the scanners and system to collect and redeem Loyalty Credits and redeem Offers are available during store opening hours, you understand that there may be circumstances where the scanner and/or system is unavailable, and you will not be able to collect or redeem Loyalty Credits or redeem Offers.

Our liability, whether based upon (attributable) default, unlawful act or any other ground, is limited to direct damages only and shall not exceed the total, cumulative amount of EUR 500.

Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence or wilful misconduct; (ii) fraudulent representations made by us; or (iii) any other liability that cannot be excluded or limited by applicable law.

SCOPE AND DURATION

The CENTRE may at any time change the authorization rules and conditions to access and circulation of ANIMALS (means dogs, excluding any other animals) in the Freeport Lisboa Fashion Outlet facilities.
Likewise, for safety, public order, accessibility, legal, administrative, technical reasons or any other reason that the CENTRE deems justified, the CENTRE may suspend, in whole or in part, temporarily or definitely, the application of this Regulation, as well as the authorization of access to and circulation of ANIMALS in the Freeport Lisboa Fashion Outlet facilities.
Rules and conditions laid down in this Regulation do not in any way harm or affect the access and circulation rules set in the Portuguese law with regard to assistance dogs (Decree-law 74/2007, of 27th March).
Under Portuguese legislation in force, particularly under Decree-Law 312/03, of 17th December, access to the shopping mall Freeport Lisboa Fashion Outlet facilities is strictly forbidden to dangerous animals including dogs of potentially dangerous breeds and cross-breeds of such dangerous breeds.

Dangerous dog breeds and cross-breeds of such dangerous breeds are the following: Fila Brasileiro (Brazilian mastiff), Dog Argentino, Pitt Bull Terrier, Rottweiler, American Stafforshire Terrier, Stafforshire Bull Terrier and Tosa Inu (Japanese mastiff).

It is strictly forbidden access of ANIMALS to:

public toilet facilities, including access corridors to toilets/baby care facilities;
technical areas closed to the general public;
service areas and food display areas in restaurants or cafeterias,
Units, except if the Units expressly accept animals in its interior.

SHOPS are run by entities independent from the CENTRE and SHOPS may, in their sole discretion but without prejudice to 1.3. above decide on conditions of access and circulation of ANIMALS in their own shop facilities. Units that authorize access to animals to its interior are identified with correspondent signage.
The CENTRE reserves the right to:

check the ANIMALS before authorizing access to the Freeport Lisboa Fashion Outlet;
deny access to the Freeport Lisboa Fashion Outlet of ANIMALS that, due to their own characteristics, behaviour, probable poor health or lack of grooming pose or may pose any risk or may disrupt the normal and regular operation of the CENTRE, safety and/or the well-being of the CUSTOMERS, employees, shop owners and of the remaining ANIMALS authorized to circulate in the Freeport Lisboa Fashion Outlet facilities;
deny access to ANIMALS in the Freeport Lisboa Fashion Outlet building in case the CENTRE reaches its maximum capacity $$e.g. 15 ANIMALS simultaneously for every 3-hour period (three hours)$$.

Authorization of access of ANIMALS to the Freeport Lisboa Fashion Outlet interior shall be given by registering at the Information Centre and subject to the use of a leash (max. up to 2 meters long).
The CENTER reserves the right to:

to examine the ANIMALS before authorizing their access to the facilities of the Freeport Lisboa Fashion Outlet;
not to authorize access to the premises of the Freeport Lisboa Fashion Outlet of ANIMALS that, due to their characteristics, behavior, possible illness or lack of hygiene, represent or may represent a risk or may put at risk the normal and regular operation of the CENTER and the safety and/or well-being of its CUSTOMERS, collaborators, employees and other ANIMALS authorized to circulate;
not to authorize the access of ANIMALS to the premises of the Freeport Lisboa Fashion Outlet in the event that the established capacity limit is reached [i.e. 15 (fifteen) ANIMALS circulating simultaneously per 3 (three) hour period];
Request the OWNERS and respective ANIMALS to leave the CENTER in case of disturbance to the safety and/or well-being of other CUSTOMERS, employees and remaining ANIMALS authorized to circulate in the CENTER.

Authorization for the access and circulation of ANIMALS on the premises of the Freeport Lisboa Fashion Outlet must be made upon presentation of the Health Bulletin (for dogs and cats) or the Identification Document for Companion Animals and will be conditioned to the circulation of these in carts or bags suitable for the transport of animals or, in the case of dogs, to the use of a non-extensible leash of no more than 2 (two) meters in length.
The accreditation and access authorization are valid for a single visit, i.e., the OWNERS must follow the procedure for accreditation and obtaining access authorization each time they visit the facilities of the Freeport Lisboa Fashion Outlet.

Question 44

LIABILITY OF ANIMAL OWNERS

By entering the Freeport Lisboa Fashion Outlet facilities with ANIMALS, OWNERS undertake responsibility and liability for all damage, personal or material, or losses that such ANIMALS may cause to the CENTRE, SHOPS, CUSTOMERS, other OWNERS or other ANIMALS.
Under no circumstance is the CENTRE liable for compliance with obligations of animal vaccination or delousing, OWNER being the sole person responsible and liable for such obligations.

LAW AND JURISDICTION

This Regulation is governed by Portuguese Law in force at all times.
All disputes arising under this Regulation shall be subject to the exclusive jurisdiction of the District Court of Lisbon.

The entry of ANIMALS into the CENTER implies full acceptance by the OWNERS of all the rules of these Regulations.
In addition to the above, OWNERS will always be responsible for complying with the legislation in force regarding pets.

The Freeport Lisboa Fashion Outlet is a private space so the presented standards must be met.

In addition to guide dogs, other dogs and cats are allowed in the centre, as long as the requirements of the ‘we are pet friendly’ regulation are complied with. The entry of any other type of animal in Freeport Lisboa Fashion Outlet’s facilities is forbidden.

All visitors must act in accordance with rules and values of citizenship and coexistence in spaces open to the public, being properly dressed, not being allowed to drink alchoolic beverages outside the authorized / licensed spaces.

We are not responsible for any accident, theft or loss of personal belongings.

It is not allowed to entry even ride or use bicycles or other means of transport such as kick scooter, trycicles, skateboarding or rollerblading, and obstruct or interfere with the normal course of pedestrian traffic.

It is not permitted to promote any commercial activity, public collection or other types of contributions, donations, without the prior consent of the administration of Freeport Lisboa Fashion Outlet.

It is not allowed to film or photograph for commercial purposes without prior permission from the administration of Freeport Lisboa Fashion Outlet.

In case of refusing to follow this code of conduct, may be asked to leave. The Freeport Lisboa Fashion Outlet commercial space. Management reserves the right to deny entry to Freeport Lisboa Fashion Outlet.

1. Scope of Application

1.1 These terms and conditions of use of this gift card (the "Terms and Conditions") apply to any purchaser (the "Purchaser") and any Cardholder (the "Cardholder"; the Purchaser and the Cardholder together also as "You") of this gift card (the "Gift Card"). By purchasing and/or holding the Gift Card, You are agreeing with these Terms and Conditions.

1.2 The Gift Card is issued by Freeport Leisure (Portugal), Sociedade Unipessoal, Lda., with its registered office at Avenida Euro 2004 (Entrada Principal), nr. 1298, 2890-154, Alcochete, registered at the Commercial Registry Office under the sole registration and taxpayer number 504780034, with the fully paid up share capital of €50,000.00 (the “Centre”), through the technical service provider, Giftify S.A with the address Cantersteen 47, 1000 Brussels, Belgium.

1.3 The Gift Card is issued and purchased only in EUR (Euros). The Gift Card must be purchased in the legal tender currency of the country where it is issued.

1.4 No additional funds may be added to the Gift Card after the initial purchase, except in the event that a merchant refunds a transaction on the Gift Card. These terms and conditions are available online at freeportlisboa.giftify.me.

1.5 The Gift Card is not a regulated product and is therefore not subject to the Electronic Money Regulations or the Payment Services Regulations.

2. Definitions

2.1 "Gift Card" means the product consisting of a prepaid card offered under these terms and conditions of use.

2.2 "Purchaser" refers to the contracting party that demands or acquires a Gift Card and makes use of it. The cardholder may or may not be the Purchaser of the Gift Card.

2.3 “Cardholder” refers to the person who makes use of the gift card.

2.4 "Seller" or "Centre" refers to the establishment where the Purchaser may acquire the Gift Card and in the premises of which the Gift Card can be used.

2.5 "Merchants" refers to the different establishments where services are provided to Gift Card holders and authorised to accept the Gift Card.

2.6 "Limited Network" means the establishments selected under Article 2.4 of this document.

2.7 “Us” or “We” refers to the Centre.

3. Purchase and loading of the Gift Card

3.1 Purchase

3.1.1 You can purchase the Gift Card:

i) in the premises of the Centre;

ii) over the Internet; or

iii) by wire transfer payment if you are a Company (VAT registered). If the wire transfer does not match the specified purchase value, the transaction will be rejected.

3.2 You can activate your Gift Card:

3.2.1 at the information desk in the designated Centre; or

3.2.2 on the website freeportlisboa.giftify.net by entering

i) the number of your Gift Card; and

ii) the order reference which will be sent to you by email.

3.3 The validity period for each Gift Card will commence on the exact date of purchase. The funds loaded onto the Gift Card will remain available for use for a duration of twelve (12) months, starting from the date of purchase.

3.4 To load the Gift Card, you

3.4.1 may use a credit or debit card issued by a regulated financial institution and approved payment method at the Centre,

3.4.2 may use the freeportlisboa.giftify.net or

3.4.3 only If you are a company (VAT registered), you may use wire transfer.

3.5 You agree to pay in EUR.

3.6 The Centre may refuse to issue or sell the Gift Card, without any justification and without the Purchaser being able to claim compensation for it.

4. Using the Gift Card

4.1 The Gift Card may be used by the Card Holder or may be given to another person (new cardholder) who received the Gift Card as a gift. When handing over the Gift Card, the new Card Holder is responsible to comply with the terms and conditions of use of the Gift Card.

4.2 The Gift Card is meant to be spent only in the participating stores within the premises of the Centre identified on the Gift Card. The participating stores can be consulted on the Centre’s website.

4.3 The Gift Card is intended solely for use in the participating Centre’s Merchants and points of sale, and solely for transactions carried out in the presence of the Cardholder.

4.4 Acceptance of the Gift Card by every participating Merchant cannot be guaranteed. It is advisable to check with individual retailers before attempting any transactions.

4.5 Your balance will be reduced by the amount of each purchase you make.

4.5.1 If the funds available on the Gift Card are completely used, and a purchase exceeds the remaining balance, you may utilise another accepted payment method, such as a credit or debit card or cash, to cover the outstanding amount, provided that the merchant accepts multiple forms of payment.

4.5.2 If any purchase exceeds available funds or card limits, your purchase will be denied.

4.5.3 Additional funds cannot be added to the Gift Card after purchase.

4.6 The Gift Card is not a debit card backed by a bank account. No interest will be generated on the funds loaded on the Gift Card.

4.7 You may not use your Gift Card for:

4.7.1 Pre-authorised periodic payments;

4.7.2 Transactions outside the Centre

4.7.3 Online transactions, even on the websites of the Centre’s distributors

4.7.4 Cash transactions, including cash repayments, bank withdrawals, postal transfers, travellers’ cheques, ATM withdrawals, foreign currencies or foreign exchange transactions, or

4.7.5 Any illegal purpose.

4.8 Your Gift Card cannot be used in situations where the Merchant/Centre is unable to obtain online authorization guaranteeing that there are sufficient funds to complete the transaction.

4.9 The Centre is not responsible for the quality, safety, legality or any other aspect of the goods or services purchased with the Gift Card.

4.10 The Gift Card may not be exchanged or resold and may not give rise to the payment of any monetary consideration.

4.11 You must not alter the Gift Card, or the related services provided in the context of the Gift Card usage.

4.12 We may stop, suspend or restrict your Gift Card for reasons related to:

4.12.1 The security of your Gift Card, Gift Card number;

1412.2 Suspicion of unauthorised or fraudulent use of your Gift Card. To the extent possible, you will be informed before stopping, suspending or restricting your Gift Card. The requirement to inform you does not apply where reasonable security measures are compromised, or it is illegal to do so.

4.13 To mitigate the risk of fraud, money laundering, and other financial crimes, additional personal information and evidence of identity may be requested before activating an online sale.

4.13.1 Failure to provide the requested evidence of identity, or if we, at our sole discretion, are not satisfied with the evidence presented, reserves the right not to issue a Gift Card. Our decision is final, and we are not obligated to provide a reason for refusing to issue a Gift Card.

5. Payment transactions

5.1. The Centre is entitled to assume that a transaction is authorised by you where the Gift Card's magnetic stripe is swiped at the merchant, or where appropriate information is provided to the merchant in order to allow the transaction to be carried out.

5.2. A transaction cannot be cancelled once it has been transmitted to the Centre with your authorization. Typical refusal grounds are:

5.2.1. A transaction exceeds the funds available on the Gift Card; or

5.2.2. If the Centre has reasonable grounds for doing so under the rules of the payment system (Visa or MasterCard) for which your Gift Card was issued; or

5.2.3. If the Centre has reasonable grounds to believe that such action is necessary in order to comply with any legal obligation.

5.3. The Centre may not carry out transactions in the event of force majeure or technical problems attributable either to the Centre, Giftify or to the Merchant.

5.4. The participating Merchants are not an affiliate and/or agent of Giftify, or the Centre.

5.5. Giftify/the Centre bears no responsibility for the safety, legality, quality or any other aspect of the goods and/or services purchased with a Gift Card.

5.6. Giftify/the Centre bears no responsibility for any dissatisfaction with the goods and/or services purchased with a Gift Card.

5.6.1. Cardholder complaints regarding their dissatisfaction with the goods and/or services purchased with the Gift Card shall not be accepted.

5.6.2. For any dissatisfaction with goods or services purchased using the Gift Card, the Cardholder should address concerns directly to the relevant Merchants. Returns or exchanges for purchased items will be subject to the individual policies and applicable regulations of the respective Merchants. It is important to note that some Merchants may require the presentation of a purchase receipt for merchandise returns.

5.6.3. Credit to the Gift Card arising from a return and/or exchange may not be accessible for use for a period of up to 10 business days.

5.6.4. If a Cardholder raises a refund complaint due to funds not appearing on the Gift Card, they will be asked to provide valid proof of refund, typically in the form of a merchant receipt. If the Cardholder is unable to provide proof of refund, they will be encouraged to request such proof from the merchant before reaching out to customer services. Providing valid proof of refund enables Giftify to effectively address and resolve the Cardholder's concern.

5.7. Transaction Complaints on fraudulent grounds, including but not limited to the theft or loss of the Gift Card details or the physical card itself cannot be accepted. Cardholders will instead be redirected to our lost/stolen policy (see point 11 herein with).

5.8. Cardholders have 15 calendar days to raise any complaint from the date of transaction. To initiate this process, please consult point 10 "Customer Services" of this document.

5.9. In certain circumstances, a transaction can be initiated but not completed (pending authorisation) which may result in the value of the transaction being deducted from the Gift Card despite its rejection.

5.9.1. In these cases, you must contact customer services and present evidence that the transaction has been refused and/or cancelled.

5.9.2. Giftify retains the right to impose a waiting period (freeze) of 10 working days prior to reinstatement of the blocked amount onto your Gift Card.

Question 53

6. Transactions in foreign currency

The Gift Card is intended to be used in the currency of the transactions in the currency of the Gift Card. The Centre has the right to deny transactions at its discretion.

7. Checking your balance

Accepted Answer

To check the available balance on your Gift Card or to review your transactions visit freeportlisboa.giftify.me or, depending on availability, call your Centre's or, go to the Centre's information centre or scan the QR code on the reverse of the Gift Card.

Question 55

8. Refund

Accepted Answer

Your Gift Card is not subject to the regulations applicable to issuers of electronic money and therefore you are not entitled to any refund of the Gift Card balance.

Question 56

9. Gift Card Expiration

9.1. Both your Gift Card and the balance loaded onto it will expire twelve (12) months after the Gift Card's purchase date. On that date, the Gift Card will cease to function and may not be used as a method of payment.

9.2. The validity period will start from the date of purchase of the Gift Card using one of the forms mentioned in point 3.1 herein.

9.3. The expiration date is available on the website freeportlisboa.giftify.me. You can also check it at the Centre.

9.4. Once your Gift Card has expired, the remaining funds cannot be used. You will not be entitled to any refund of your Gift Card balance.

11. Security Precautions

Accepted Answer

11.1. Only use the Gift Card or its number to enter into (or undertake to enter into) a transaction, and,

11.2. If your Gift Card is lost or stolen, or if you believe that it (or its number) may have been used illegally, you must:

11.2.1. Please refer to Point 10 - Customer Services to report a lost or stolen Gift Card.

11.2.2. Immediately stop using your Gift Card and its number.

11.3. If you find the Gift Card after reporting that it has been lost, stolen or illegally used, you must destroy it and notify Giftify as soon as possible.

11.4. You will be responsible for any use of your Gift Card until your Gift Card has been confirmed blocked via email by the Centre or Giftify.

11.5. The Centre is not responsible for the funds stolen or fraudulent usage as a result of lost or stolen Gift Cards.

11.6. If your Gift Card, or any replacement card, is lost or stolen, you may, once the loss is reported, request a replacement card from the Centre. When demanding a replacement gift card, a proof of payment of the loaded amount shall be requested, otherwise the replacement card shall not be issued. You will be charged a fee before a replacement card is being issued. This is further explained in the summary table at the end of this document.

11.7. We are not responsible for:

11.7.1. any abnormal or unforeseeable circumstances, for example, a failure of computer systems that occurs for reasons beyond our control, if this prevents us from providing a regular service;

11.7.2. any merchant who refuses (or there is a delay in accepting by the merchant) to accept your Gift Card or Gift Card number, or

11.7.3. In case of errors about the transactions, contact Customer Services according to Point 10 herein with.

11.8. If your Gift Card is not working properly, you can get a new one at the point of sale in the Centre. Before a replacement card is issued, a replacement fee shall be charged and then the remaining balance of your Gift Card will be transferred to the new Gift Card.

11.9. Our liability in any event is limited to the balance on the Gift Card.

11.10. The balance already used before the Gift Card is blocked cannot be refunded.

11.11. Any use that does not respect these terms and conditions may result in the blocking of your Gift Card.

12. Modification of Terms and Conditions of Use

12.1. The terms and conditions of use, as well as the prices and additional charges, may be modified at any time.

12.2. If modified, the terms and conditions of use applicable shall be those in force on the date of purchase of the Gift Card.

15. Cancellation rights

Accepted Answer

15.1. If you change your mind about the Gift Card purchased online and have not used the Gift Card nor the balance of the Gift Card has changed from the initial purchased amount, you have the option to cancel it within fourteen (14) days of the date of purchase. You will not be charged for cancelling the Gift Card during this period. You will be refunded the Gift Card balance and any fees that you have paid in regards to the purchase.

15.2. The reimbursement will be conducted using the same currency as the one associated with your Gift Card.

15.3. To initiate the procedure of cancellation and of refund within fourteen (14) days from the date of the online purchase of the Gift Card, You are required to send an email to freeport.info@viaoutlets.com including the following necessary information:

Order Reference
Date of purchase
Proof of purchase
Name of the Centre where Gift Card was purchased

15.4 Upon receipt of all necessary documents, the request will be reviewed and it may take up to fifteen (15) business days, from the date of submission for the refund to be processed. Without the necessary information, processing the refund will not be possible.
